No, trademarks are only valid in the jurisdictions where they are registered. For example, a European Trademark is valid across EU member countries but not beyond. Similar to how a corporation is chartered by a specific state, a country cannot extend trademark protections beyond its borders. Despite various multinational agreements and treaties, there is no universal trademark protection. We recommend registering your trademark in all jurisdictions where you currently operate or plan to operate soon.
What about the Madrid Protocol/WIPO?
Many clients inquire about international registration through the Madrid System. The Madrid System allows you to extend a trademark application from your home country (a signatory country) to other signatory countries. However, each extension is treated as a separate application and is subject to the procedures and requirements of the respective country. If there is an opposition or objection, a local attorney must respond, as the attorney from your home country cannot. Since WIPO applications can be more costly, we suggest registering in each country individually. However, if you plan to apply in many countries at once, the Madrid System might be more suitable for you.
